Horton vs Dig

...Horton v. DIG In Horton v. DIG, the plaintiff and the defendant were both found for certain degree of negligence against them. However, Horton prevailed in this case and the case was settled as Horton receiving 80% of what he originally sued DIG for. The settlement basically means that Horton’s negligence contributed 20% to his own injury and that DIG’s contributory negligence contributed 80% to Horton’s injury. The ruling was based on the rescue doctrine of the law which holds that “if a tortfeasor creates a circumstance that places the tort victim in danger, the tortfeasor is liable not only for the harm caused to the victim, but also the harm caused to any person injured in an effort to rescue that victim.”(Wiki) In this case, Horton was the rescuer and DIG was the tortfeasor. D.I.G. Contracting, LLC was hired by Fordham University to dig the foundation for a new dorm to be built. However, DIG did not follow the requirements of NYCRR 753-3 which is the regulation that give the local governing body the time to mark any underground gas or electric lines that must be avoided. DIG’s backhoe then hits the gas line which caused the explosion. Horton who has brittle bone disease witnessed the whole event and saved Mr. Employee who was thrown in the air by the explosion from landing on the ground. The issue here is whether the contracting company is liable in negligence for causing injury to the victim who suffers from brittle bone disease. We will examine each and every......

...92% and pulse was 86.At 10:30pm I call the night shift R.N to follow up on the condition of the resident and he told me she was doing fine. My Other mistake was I didn't call my instructor right away. I thought it was ok to tell her the next day which was the last day of the clinical but I wrote everything on my report what happen. Also when I asked my preceptor if my instructor would be informed she said the D.O.N will report it to her as soon as she gets the incident report from us. Then in the next morning the preceptor nurse came angry she assigned me only four new patients and told me to get a urine sample form catheter of the patient I never work with, and I said never done it before but i will try if you watch me. So I went to the med room to get the syringe but I couldn’t find it. Then she went by herself to get me one and it took her ten minutes to come back to the room. While she was gone I saw a syringe on the bathroom counter top from a distance which I thought was the night shift made it ready for us, so I went to my preceptor told her about the syringe but that syringe was open and not the right one. For that reason she reported it me as I was going to use it by neglecting my sterile technic. I know how big of responsibility it is to be a nurse; it is a responsibility of life and death. I was lucky enough nothing happened to the patient I gave wrong medication, but I am sure it gave me life time lesson and hopefully it will make me a better nurse. I......
